Legal register preparation for EHS

Legal register preparation related to Environment Health Safety

Legal register : A document/ form which that list down of legislation, regulations which is applicable to our organization operation.

Why we required legal register ?

It is not mandatory for a company to have a legal register but tracking their compliance again various rules and regulation will be very difficult. Moreover it will be very helpful if we create, we can identify the exact requirements (includes new requirements).

How to create a legal register :

For creating a legal register we need to look at various aspects which are explained below as follows

Note : I have taken India (State- Tamil Nadu) as an example

·       Generally for any industries at India certain basic act/laws are applicable which are as follows

Ø  Industrial safety and health act and rules

Ø  TN Contract Labour (Regulation & Abolition Rules - 1975)

Ø  Tamil Nadu Fire Service Act & Rules

·       List down the manufacturing process carried out by your organizations  - Analysis if any special requirement.

Example :           Boiler                  -             Boiler act is applicable

                             Gas cylinder       -             For gas cylinders

·       List down the chemicals used in the industry, check whether any hazardous chemical you are going to use which requires permission for storage

Example :           Manufacture, Storage and Import of Hazardous Chemicals Rules 1989

                             Petroleum act & rules for petroleum product

                             ARMS Act, 1959 for sulphur

                             Medicinal & Toilet preparation Rules, 1956

                            

·       Check whether any special requirement is applicable for producing your product.

Example :                   Food industry                 - Food Safety and Standard act is applicable

Cosmetics industry         - Drugs & cosmetics act is applicable

·       Check the environment rules & regulation applicable to your factory

Example :          

Hazardous and Other Wastes  Rules, 2016            - If we are generating hazardous waste

Water (Prevention & control of pollution) act, 1974

Air (Prevention & control of pollution) act, 1981

Plastic waste management rules, 2016                  - If we are producer of plastic /brand owner.

Bio-medical waste management rules, 2016        - If we are generating Bio medical waste

E-waste (management) rules, 2016                       

How to create a health legal register :

            A committee to be formed & It should have cross functional team members (Finance, Quality, HR, Engineering etc). Need to be driven by top management.

 

Periodicity for reviewing a legal register :

Frequency of reviewing – Monthly once.

How to get the updates if any change made by enforcement body :

Ø  We should frequently visit the sites of concerned enforcement authorities (at least once in 6 month)

Ø  Becoming a member of professional (local) bodies/ peoples like national safety council, Industrial waste management association etc.       

What can be the plan after implementation of legal register :

    Manual legal register maintained in a excel will consume lot of our time for tracking and maintenance. To avoid this we can create a mechanism for automating it (for follow-up, status collection etc).

                                        WASTE MANAGEMENT HIERARCHY 


Definition of waste and hazardous waste : 

Waste is a product which is no longer suitable for its intended use.

Hazardous waste is a waste which has potential to cause harmful effect on human health or the environment.

 4R concept can be followed in any waste generation areas which can reduce your waste generation level substantially (both in industry & society). 4R are as follows

    1. Reduce : 

                        Reduce means reducing the waste generation at source itself.

Examples are use drying methods like paddle dryer, solar sludge dryer to reduce the industrial sludge moister consent which can reduce the sludge generation.


    2. Re-use : 

                        Check the possibility of re-using of the generated waste in the same application or some other application.

Examples are use of steel tea cups in place of paper cups, Use of copper bottles instead of one time usage water bottles, Usage of bags (Cloth etc) instead of plastic bags, re-using of chemical cans in Waste treatment plants, effluent treatment plants etc

    3. Recycle : 

                        Always try to use materials which are possible to recycle. Eliminate single usage plastic/material. Recycling a waste may not be possible at our end, so select vendor who has capable to carryout this and dispose it accordingly.

Examples are use of plastics/paper packing instead of single usage plastic.

    4. Recovery : 

                        If the above 3 options are not possible, we can go for recovering energy form the waste.

Example are Check/analysis the characteristics of the materials. Based on the result, if the result has high calorific value the same waste can be used as an alternate fuel in cement industry instead of coal. Which can reduce the consumption of our natural resource.


Always try to follow the 4R concept on waste management. Try to avoid dumping in land, it is major source of contamination and pollution. Dumping in land will affect our eco system very badly. Let us unit for creation of safe environment for our next generation.

How to get sanitary certificate from health department in Tamil Nadu

Sanitary certificate will be issued by our health department. Check with your local health inspector whether it is applicable to your industry/institution. 

Procedure for getting the sanitary certificate are as follow

1. Speak to your local health inspector for getting information related to filling challan (head of account, Data processing code, amount to be paid)

2. Visit tahsildar office - Treasury block/department at your Location to get challan

3. Fill the challan with the details provided by your local health inspector and make Payment in the bank and get a challan copy.

4. Prepare Covering letter mentioning the requirement and challan details. Also mention about the supporting documents which your are planning to attach along with covering letter. Normally the below mentioned attachments will be submitted along with the covering letter

a.       Approved hp and layout details from health department

b.       NOC from fire department

c.       Air & water consent issued by pollution control board

d.       Hazardous waste authorization issued by pollution control board

e.       Factory license issued by inspector of factories

f.        Challan copy

      5. Submit the application to Director/Deputy director of public health & preventive medicines (Always it is better to check with your local health inspector before addressing to the government officials)

      6. Based on your application representatives from health department may come & visit your premises.   

      7. If there is no observation/query, you will get sanitization certificate within few working days


Note : Validity of this sanitary certificate will be one year from the date of issue. You need to renew the certificate before expiry and follow the above said process for renewal also (Include a copy of  previous sanitization certificate as an attachment)

INSPECTION OF COMPRESSED GAS CYLINDERS

 The following things need to be checked before allowing any compressed gas cylinders inside an industry.
  • Check whether nozzle cap available on the cylinder.
  • Check the bottom of the cylinder & reject the cylinder if any corrosion found on the cylinder/any damages found.
  • Check for any dent/crack/fire marks on the body of the cylinder.
  • Check for any unauthorized modifications made on the cylinder.
  • Look for the next date of hydrostatic testing which is normally marked on the metal ring inserted between the valve and the neck of the cylinder and if the date of testing is on due don't allow the cylinder inside.

    • Gas cylinder is coded as per the colour coding requirement.
    • Check the cylinder has been labelled with the name of the gas and the name and address of the person by whom the cylinder was filled with gas.
    • Additionally consider any local legal requirements if required like Placing “A warning in the following terms shall be attached to every cylinder containing permanent or liquefiable gas, namely: -
                                  “WARNING”
    (i)              Do not change the colour of this cylinder.
    (ii)            This cylinder should not be filled with any gas other than the one it now contains.
    (iii)          No flammable material should be stored in the close vicinity of this cylinder or in the same room in which it is kept”.

·       Awareness of safety system forms Integral part of building the Safety Culture in the plant for employee and stack holders.
 
 
 

General instruction:

·       All truck rivers are requested to record their entry in the register along with vehicle details (Driving license, Insurance & RC of vehicle) available at the security gate.

·       A visitor card will be provided by the security. Please read the visitors card carefully and follow the safety guidelines as mentioned in it. Visitors have to be accompanied by an Company employee from the reception.

·       Drive vehicle only at 10 km/hr

·       Check for movement of pedestrian on zebra crossing etc.

·       Please follow the path for vehicle movement & check the  provided inside the premises

·       Smoking not allowed inside the premises (mention also about carrying/usage of tobacco/alcohol)

·       Truckers drivers/visitors are not allowed to carry any flammable, sharp materials inside the premises

 


Area specific safety instructions:

·       Check your delivery/unloading time with the warehouse team and wait accordingly (on the vehicle parking area)

·       Reach the spot (loading/unloading spot) on the allocated time.

·       Always do vehicle reversing with the help of cleaner/security

·       Place wheel stopper & steering lock & handover the key to security.

·       Please don’t wash/clean the vehicles inside the company

·       Take rest only in allocated areas ( Don’t sleep below the vehicles)

·       Please don’t enter in to any barricaded or restricted area/un-authorized area.

·       Don’t leave the vehicle un-attendant

·       Please take food only in allowed area & don’t use gardening water for drinking purpose.

How to react in-case of fire & medical emergency:

·       In Case of Fire, fire alarm will be hooted for evacuation of the building. You are requested to follow the instructions of host to reach the nearest emergency exit. Don’t run, walk briskly towards the Emergency assembly point which is adjacent to the “Mention the areas”.

·       A Well-equipped medical Centre and an ambulance with lifesaving medical equipment are available for handling medical emergency. In-case of any medical emergency call “Mention intercom number”

How calcuate the CO2 reduction after implemenation of/planning to implement a Fuel conservation projects

How calcuate the COreduction after implemenation of /planning to implement fuel conservation project.

  • Type of Fuel used:  Diesel/Electircity
  • Approximate consumption of fuel(Diesel) for running the device/day : 600 litre/day
  • Now after implementation of this project the device will run for 14 days instead of running the device for 26 days and the approximate CO2 reduction will be 1584 kg/day.
The calculations are as follows for Diesel:

·        1 litre of diesel weighs 835 grams.

·        Diesel consist for 86.2% of carbon, or 720 grams of carbon per litre diesel. In order to combust this carbon to CO2, 1920 grams of oxygen is needed.

·        The sum is then 720 + 1920 = 2640 grams of CO2/litre diesel.

·        An average consumption of 600 litre/day corresponds to 600 litre/day*2640 grams of CO2/litre   = 2640*600/1000 = 1584 kg/day
The calculations are as follows for Electricity are as follows:

Assumption : the electricity consumption for the device will be 450 Units/day (if we did = 450/24 units/hr  = 18.75 units/hr)

Amount of CO2 generation is 973 grams/KWH ( average data taken for generating the power from coal power plant), so approximately we can eliminate the generation of 18.75*973/1000

= 18.24 kg/hr  = 450 kg/day

The following are the points to be considered when designing weekly/monthly checklist for Material Handling Equipment’s (MHE)





 

·        3rd party inspection certificate for MHE

·        Overhead Guard - Are there broken welds, missing bolts, or damaged areas?

·        Hydraulic Cylinders - Is there leakage or damage on the lift, tilt, and attachment functions of the cylinders?

·        Mast Assembly - Are there broken welds, cracked or bent areas, and worn or missing stops?

·        Lift Chains and rollers - Is there wear or damage or kinks, signs of rust, or any sign that lubrication is required?

·        Forks - Are they cracked or bent , worn, or mismatched?

·        Tires - Are they cracked or worn?

·        Battery - Are the cell caps and terminal covers in place?

·        Are the cables missing insulation?

·        Is load chart displayed on the handling equipment?

·        Hydraulic Fluid - Check level?

·        Break – Is break is working in forward& reverse movement?

·        Break - Does the parking brake work?

·        Lights are they working properly?

·        Horn - Does the horn work?

·        Safety belt (on driver seat) available in good condition?

·        Is warning siren available in the Forklift & reach truck?

·        Does charging done in designated area?

Things to be checked when receiving industrial & domestic LPG cylinders


Following are the common things which needs to be checked when receiving industrial & domestic LPG cylinders

1.      Color coding of the LPG cylinder (whether it is domestic or industrial)

2.      Check whether the base/body of the cylinder is free from corrosion / damage which creates chance for leakage of LPG

3.      Check that LPG cylinders have the company seal and safety cap intact.

4.      Visually check body of the cylinder for any alterations (against the initial design of the cylinder)

5.      On any one of the cylinder vertical stays you can see the painting like B13.  Letter (A,B,C,D) stand for quarters

·        A for March (First Qtr),

·        B for June (Second Qtr),

·        C for Sept (Third Qtr),

·        D for December (Fourth Qtr).

The digits stand for the year on which next testing to be performed. The above mentioned painting  “D20” on the vertical stays communicates that the cylinder is due for Hydrostatic testing on the 4th quarter of 2020.

·        Please maintain the safe distance from powered equipment or Conveyors which may or may not be in motion.

·        Please do not cross pedestrian limit of the delineated foot path,  entry beyond these limits should be done under the supervision of authorized personals

·        Please do not walk on the path demarcated for the movement of materials.

To check gas release in an atmosphere can generate flammable mixture concentration (between LFL & UFL)

Purpose of Study             :              To find whether gas release in an atmosphere can generate flammable mixture concentration (between LFL & UFL)

Location                             :              Cylinder storage area 

As we aware that the Flammable Range (Explosive Range) is the concentration range of a gas or vapor that will burn (or explode) if an ignition source is introduced.

Three basic requirements must be met for explosion to take place:

  1. Fuel
  2. oxygen or air
  3. source of ignition






    Below the explosive or flammable range, the mixture is too lean to burn and above the upper explosive or flammable limit the mixture is too rich to burn. The limits are commonly called the "Lower Explosive or Flammable Limit" (LEL/LFL) and the "Upper Explosive or Flammable Limit" (UEL/UFL).

    From this study we can find out whether a gas release in an atmosphere can generate flammable mixture concentration (between LFL & UFL)
